POSSESSION: The owner is to retain full possession rights and assume full responsibilities and liabilities for the puppy. Owner may NOT sell, or in any other way, transfer ownership or possession of the puppy without written consent of the breeder. Each Party to this contract agree to defend and hold harmless the other parties in the event of any lawsuit brought because of the actions of the puppy while in the sole possession on that party. Signature(s) ___________________________________ JBK CARE & CONDITIONS: 1. The owner has the sole responsibility for the proper feeding and nurturing of a Developing puppy. (JBK Recommends Purina Pro Plan dog Foods, Eukanuba, or Diamond Products). The Owner will never knowingly nor through neglect, place the puppy in harm’s way. The Owner will also, to the best of his/her ability, keep the puppy in proper health and condition. If the owner falls ill or unable to care for hte dog the dog is to be surrendered back to JBK. JBK will re-home the dog with another family. 2. The owner shall properly care for, feed and provide adequate medical attention for such dog. The term “properly care for” shall mean a premium dog food (kibble &/or raw), adequate amounts of fresh water, provision for shelter, a dog run or a fenced in yard and maintenance fecal exams or any required routine or emergency Veterinarian care. 3 It is understood that this dog will not be allowed to roam free; and will either be confined to The “HOUSE”. The backyard, kennel run or on a leash is acceptable for play and potty times. Underground fences are okay; however, it will not keep the puppy safe from other dogs/animals or prevent it from being stolen. 4. It is understood that this puppy/dog will NOT be chained or tied up at anytime. 5. It is understood whether said dog shows in the conformation ring or is a family companion, it will be kept as a loving pet. 6. It is understood that his puppy will not be allowed to ride in the back of a pick up truck UNSECURE at anytime. 7. It is understood that the breeder will be updated of any address/phone number changes within 30 days of a move. 8. It is understood that the breeder expects pictures and updates on the dog as it progresses throughout its lifetime whether it be through postal service, Face Book or e-mail each year. 9. If sold as a companion, said puppy is to be spayed/neutered at the age of 8-10 months of age.All cost for spay and neuter are the responsibility of the new owner. If puppy is not spayed/neutered by 10 months of age the health guarantee will be void and null and AKC papers will NOT be given to the buyer. Proof shall be a verifiable receipt or letter from your licensed vet of completion of the spay/neuter.All cost for spay and neuter are the responsibility of the owner. Said dog or bitch will be returned for Breach of Contract and purchasers expense. 10. It is understood that no money will be refunded for a replacement show prospect. Show criteria may be a disqualifying fault for the show ring, or genetic defects. In these cases, WRITTEN PROOF from a Certified Trainer, Certified Veterinarian or a Current Practising AKC show judge will be required to verify the existence of the condition. After said dog is returned to the breeder and is determined to be in GOOD- Healthy condition, the breeder shall have 24 months to replace said pup/dog to the buyer in exchange for the original dog. All shipping expenses to return said pup/dog to the breeder are sole responsibility of the buyer. 4. "IF" sold as a show prospect said puppy will be sold on co-ownership with the breeder remaining on the papers as co-owner of said puppy until a Championship title has acquired all OFA Hip Good or Better Results, Eye Cerf is Clear. Health screenings have been preformed and copies of certificates have been received by breeder. ) Any and All issues that arise with the puppies health the Co-Owner MUST call and verify any procedures with the breeder. UNLESS it is a life or death immediate emergency, Where as the Co- owner will call the breeder as soon as the dog is in the capable hands of a Cerified Veterinarian. . Show prospects are to be shown 10 weekends per year. Breeding rights ARE NOT sold without Co-Ownership. And breeding right are NEVER sold to Pet Owners. 5. The health screenings are to be COMPLETED AFTER 24 MONTHS OF AGE AND BEFORE 28 MONTHS OF AGE. The Breeder will retain original Registration papers and a Copy will be sent to buyer. When all requirements have been fulfilled the breeder will sign off on the AKC papers. (Note) The Breeder shall also retain stud rights to any male puppies owned, co-owned or leased at that time after 24 months of age to be bred free of charge. (or may retain breeding to females) The breeder will be responsible for shipping expenses to and from the stud dog’s residence. (Please note that breeder may elect to never use said dog as stud, or brood bitch, BUT has the option to do so anytime after 24 months of age. Signature ___________________________________________________________ JBK EXPENSES: All ordinary expenses for the daily existence and well being of the puppy; to include general care, medical expenses, general training, entries for obedience, conformation, herding, agility, track and field or other activities are the responsibility of the owner. The breeder offers a $100.00 reward rebate for titles the dog may earn under American Kennel Club (AKC) or Australian Shepherd Club of America (ASCA) (Canadian Kennel Club, Internationals, & UKC titles do not count for these refunds unless the said dog has been awarded his or her AKC Grand Championship Title) and once certificate for titles earned have been received, breeder should be sent copies of the titles within 60 days of earning the titles and breeder has 60 days to give the reward rebate. The titles include: Ch. Champion GCH. Grand Champion A-Champion UD. ATD WTCH GSE AX AXJ RE-E JS-O RAE SHOW & PERFORMANCE PUPPIES AND DOGS: It is understood that is when purchasing a Show &/or Performance Prospect that at least one of the above titles is a requirement before the Co-Ownership will be signed over to the Purchasing Co-Owner (for sole ownership) In-addition to yearly eye exams, and OFA clearance of Hips and Elbows. (See below) (Exceptions may be made in certain circumstances with Jodie Keener's Written Approval) PROVISIONS & HEALTH GUARANTEE: These guarantees are the only ones made and no other express or implied warranties are made or will be honored. Said puppy is to be deemed healthy and free of any infectious diseases.. After that time, no health provisions are made with the exception of Canine Hip Dysplasia, Cataracts and Idiopathic Epilepsy. It is agreed that the owner, at the owner’s expenses have the puppy examined by a veterinarian within twenty four hours of purchase. 1. If puppy dies within 7 days, in order to receive a replacement puppy, the. Buyer MUST have a necropsy completed including a FULL blood panel and send samples to state lab for testing. A report must be provided to the breeder within 39 days of the necropsy being performed. ALL expenses are to be paid for by the buyer, If the necropsy report determines the puppy died from an accident, toxin or by abuse or neglect, NO replacement puppy will be granted! The contract will be void and null… 2. Hips and elbows are to be guaranteed to be free of canine hip/elbow Dysplasia for a period of 30 months from birth date of said puppy. If during this period, hip/elbow Dysplasia is suspected puppy will be immediately radio graphed (x-rayed) by a licensed orthopedic veterinarian and all x- rays will be submitted to the OFA (Orthopedic Foundation for Animals) for evaluation. Such medical expenses shall be paid by the buyer. Upon final diagnosis of hip/elbow Dysplasia, the breeder shall have the option of providing a replacement puppy at a later date (with in 24 months). Such remedy shall be the sole remedy available to the owner herein. It is understood that a replacement puppy will carry its own contract with the same terms and agreement and guarantee: that a replacement puppy will be provided only when the original puppy is deceased or returned; and that a replacement puppy will be dependent upon availability. It is also understood that a replacement puppy does not include shipping, health certificate or crate costs. 3. Said puppy is guaranteed against Hip/elbow Dysplasia*, Idiopathic Epilepsy*(IE) Show Home Puppy's are Guaranteed against Hip/elbow Dysplasia*, Idiopathic Epilepsy*(IE) and Scissor or Even/Level bite & Monorchid or Cryptochid (1 or no testicles) a. Cataracts guarantee- a certified canine ophthalmologist MUST provide Proof (CERF sheet/paper/Certificate) to buyer, for buyer to copy and send to breeder within 24 months of age of said puppy. If epilepsy is suspected buyer MUST do all available tests (including full blood panel, M.R.I. as these are examples) to rule out every possible situation in order to make sure that it is inherited epilepsy (Idiopathic Epilepsy). Seizures caused by toxins/trauma or any other form not genetically caused are NOT covered under this guarantee. d. Monorchid or Cryptochid guarantee-(show home only) puppy should have BOTH (2) testicles by 12 months of age, if 1 or no testicles are dropped by 12 months of age written Certified Veterinarian proof should be given by 13 months of age. 4. At the time of sale, the puppy was well socialized and of sound temperament, since the breeder can not control the environment, training or additional socialization after time of sale, no provisions are made in regards to temperament; and it is the owners responsibility to further socialize and train said puppy. HOWEVER, if there is any question as to the stability of the temperament of said puppy prior to the age 4 months, it maybe returned to the breeder for a replacement puppy, conditional upon availability, provided t he puppy is returned at buyers expenses and is returned in good health. Proof must be provided from a behavioral trainer and puppy has been properly maintained. If returned, no cash refund will be made under any condition. 5. If sold as a companion—Puppy must be spayed/neutered at 8-10 months of age as stated under “Care & Conditions” item number 9. 6. If sold as a show/breeding prospect—Breeder guarantees the dog to have an acceptable bite (scissor bite, even/level bite, or and overbite not exceeding 1/8 of an inch). If said puppy develops an undershot bite by the time it is 12 months of age, said puppy may be returned to the breeder for a replacement puppy. A replacement puppy will be conditional upon availability and provided said puppy is returned at buyer’s expense and is returned in good health with documentation of proof from a qualified Veterinarian. 7. Show & Performance prospect puppies are guaranteed to be free of disqualifying faults set forth by the AKC standards and are NOT guaranteed to gain a Championship, however breeder feels that said puppy would do well at the time of sale. Show & Performance puppies are required to be shown 10 weekends per year. Starting at 9 month of age . (exception may be approved by breeder in Writing only) REGISTRATION PAPERS & REGISTRATION NAMES: The AKC registration papers will be provided within 8 weeks of purchasing said puppy, unless puppy is being sold as a companion on a spay/neuter contract in which case papers will be withheld until Proof has been provided as it states under “ Care & Conditions” item number 9. All puppies are registered with JBK prefix or suffix. No other kennel name will be allowed on registration papers unless it has been APPROVED by the breeder in Writing . RIGHT OF FIRST REFUSAL: 1. Under NO circumstances shall puppy be taken to an animal shelter or released to a rescue group or given away without breeder’s approval of the home. 2. Buyer is to ship dog back to breeder at buyer’s expense if he/she can no longer keep the dog or wish to place it with breeder’s approval. Puppy is not to be sold, given away or transferred into anyone else’s name at anytime. No Exceptions. 3. It is understood that if said dog is returned to breeder for any reason, no refunds will be given or granted. 4. If the buyers ever transfers, give away, or sell said dog all the same terms and conditions are also applied to the person who has possession of the dog and both buyer and third party will be responsible for court cost. Health guarantee will be also become void and null and legal action will be taken. Signature: ___________________________________________________________ JBK MISCELLANEOUS TERMS & AGREEMENTS: Waiver of any part of this contract shall be deemed void or invalid under the Law, such finding shall not affect the remaining portions of the contract. If a dispute arises out of this transaction, parties agree to conduct mediation and/or arbitration prior to filing a lawsuit. Any lawsuit must be brought in the county/state where the breeder resides. The laws of the state of Texas and Johnson County. It either party is forced to take legal action to enforce any part of this contract, Actions shall be initiated in Johnson County in the State of Texas, and any legal fees and court cost shall be the responsibility of the part found in default. Violation of any part of this agreement shall be $2000.00 (two-thousand dollars and zero cents) per occurrence. Should the breeder hear or received Proof of abuse/neglect of this puppy/dog from an Animal Control Officer/Shelter/Veterinarian and received information about it’s living conditions or if the dog was bred before being spayed/neutered at 8-10 months of age (if bought as a companion), or bred before 24 months before genetic health screening has been done ( If bought as a show/breeding prospect) said puppy will be granted BACK to the breeder with it’s AKC registration papers, signed over and a fine of $2000.00 (Two- thousand dollars and zero cents) plus shipping expenses for dog to be shipped back to breeder is to be paid for breach of contract. FORFEITURE: The owner agrees that any willful or flagrant violation of the articles of this Agreement may result, at the sole and absolute discretion of the seller, in the Forfeiture of ownership and possession rights of the puppy, and all claims of the Puppy by the buyer, without refund of monies paid. This dog is to be registered with the AKC registered name. JBK______________________________PURCHASE PRICE: $_________ DATE: _____________ Deposit of $250.00-$1000.00 (depending on litter)will be taken to hold puppy until 8 weeks of age at which time the remainder of the purchase price is due and the puppy to be delivered.
